Wilmington University is committed to providing a working, educational, and social environment for all members of our University community, including all faculty, staff, and students, that is free from sexual harassment. Sexual harassment in any form is unacceptable behavior and will not be tolerated. It is a form of misconduct that undermines the institutional mission of the University. Sexual harassment may be defined as unwelcome advances, requests for sexual favors, other verbal or physical conduct, written communication or printed materials of a sexual nature when:
- Submission to such conduct is made either explicitly or implicitly at term or condition of an individual’s employment or educational experience;
- Submission to or rejection of such conduct is used as the basis for employment or academic decisions affecting such individual; and/or
- Such conduct has the purpose or effect of unreasonably interfering with an individual’s work, academic performance, participation in co-curricular activities, or creating an intimidating, hostile, or offensive working, learning, or social environment.
Sexual harassment can take many forms, and the determination of what constitutes sexual harassment will vary according to the particular circumstances. Sexual harassment may be described generally as unwelcome sexual behavior that a reasonable person would find offensive and that adversely affects the working or learning environment.
In order to promote and uphold the University’s commitment to a harassment-free environment, it is the responsibility of all members of the University community to report alleged violations of this policy to the appropriate University official. Allegations involving a faculty or staff member should be reported to the Vice President of Academic Affairs or the Director of Human Resources. Allegations against a student should be reported to the Vice President of Student Affairs. Investigations will be conducted as promptly and

Anyone who retaliates against any individual making complaints of sexual harassment, or anyone making a false or malicious charge against a member of the community is in violation of this policy and will be subject to sanctions.
